Here is a sample of the contract between the nanny and the family. A+ Nannies and Sitters, a North Carolina Limited Liability Corporation, has made a referral to ___________________________ the client, and has referred a Prospective Nanny:___________________________, for in-home child care. Since A+ Nannies and Sitters is a referral agency only the compensation of the Nannies is a matter to be determined through negotiations between the Client and the Nanny, and the company does not make any representations regarding such compensation, nor does the company have any knowledge regarding the manner and level of compensation. As a result of the Company’s efforts and referral the herein named Client has agreed to employ the above named Nanny and the client herein agrees to pay the Company a one time fee equal to Nine Hundred dollars ($900.00), or nine percent (9%) of the nanny’s first year’s salary, whichever is greater. This fee must be paid in full at the time any offer of employment is accepted. In the event that there is a dispute regarding this agreement the Client agrees that this contract is valid under the laws of the State of North Carolina and that the proper venue for the litigation of any dispute shall be Durham County, North Carolina. In the even that the client fails to pay fees within a reasonable time of the date that such fees are due, the Client hereby agrees to pay any and all reasonable attorney’s fees that the Company incurs in the enforcement of this contract. The Company makes no warranties as to the abilities or character of any nanny. Client agrees that no liabilities will be held by the Company and agrees to indemnify and hold harmless the Company, absent absolute negligence by the Company. Client agrees that the company is a referral service only and is not a party to any agreement entered into between client and nanny. By signing this agreement all parties agree that the Nanny will remain employed, if the Client so desires for a period of not less that 45 days. In the event that the Nanny does not remain employed for 45 days, the Company will replace the Nanny one time at no additional cost. After the first replacement any family will be responsible for any future costs associated with finding another caregiver or nanny. Each Party has read and understanding the above agreement had has had the opportunity to consult counsel regarding the terms of this agreement.
